These OXdreams Platform Payment Terms (“Payment Terms”) must be read, understood and interpreted combined with the General Terms and Conditions of Use and other OXdreams policies. For all legal purposes, these Payment Terms are part of the General Terms and Conditions of Use of OXdreams. Any terms referenced and undefined in these Payment Terms must be read and interpreted as defined in the General Terms and Conditions of Use.
Use of Payment Services
When carrying out transactions or selling Experiences, You will use the payment services that may be available directly by OXdreams or by third parties (“Payment Services”). By using the Payment Services, You agree to abide with these Payment Terms, without prejudice to other terms and conditions provided by a partner.
The current Payment Services are provided by PayPal and Stripe. PayPal and Stripe have their own terms and conditions and You are responsible for accepting and complying with such terms when using a Payment Service.
OXdreams may temporarily limit or suspend your access or use of the Payment Services, or its resources, to carry out maintenance measures that ensure the proper functioning of Payment Services.
You can use the following payment methods on OXdreams Platform: (i) credit cards for payment; (ii) payment slips; and (iii) PayPal account. Check your credit card installment eligibility for information on which Experiences qualify for credit card installments.
It is not possible to combine different forms of payment and/or split the payment between several credit cards for the same Experience.
Advertising User Conditions
When advertising an Experience, the Advertising User must use the Payment Services to receive the payments related to the sales of Experiences (“Payment”). You will be subjected to the terms and conditions applicable to the Payment Service for opening and managing your account. The Advertising User appoints OXdreams as a limited agent for the Advertising User with the sole purpose of receiving the Purchasing Users Payments on the behalf of the Advertising User due to the Experience provided. Every Advertising User agrees that the payment made by a Purchasing User to OXdreams as the result of the Experience provided will be considered the same as a direct payment made from the Purchasing User.
The Advertising User understands that OXdreams ‘obligation to pay the Advertising User is subject and conditioned upon recieving the corresponding payments from the Purchasing User. By accepting the appointment as a limited payment collection agent for Advertising Users, OXdreams assumes no responsibility for the acts or omissions of its Users. The Advertising User understands and agrees that, in addition to the Service Fee, OXdream may retain and deduct from any Payment any amount of tax or other fee or amount due by the Advertising User to OXdreams ou Purchasing Users (such as, for example, cancellation, return, failure to deliver the experience, among others).
Without prejudice, the Advertising User, from now on, agrees to return and pay OXdreams any amount owed by the Advertising User to OXdreams or to the Purchasing Users, at all times, when it is not possible for OXdreams to make the deduction.
Payment by the Purchasing User will be processed after booking an Experience and accepted but the Advertising User. In general, the Advertising User will receive the Payment within 72 (seventy-two) hours after the delivery of the Experience to the Purchasing User, provided there is no problem or situation reported by the purchaser.
Purchasing User Conditions
When purchasing an Experience, the Purchasing User must indicate what form of payment he intends to use. OXdreams will process the payment for a booking. You allow OXdreams to charge all due amounts from the payment method you selected, including any applicable taxes. Any additional fees for using the different payment options offered will be displayed on the Platform and included in the advertised amount, and you agree to pay those fees by selecting the payment option.
OXdreams will process each transaction in the currency of the Advertising Users’ country, according to the informed price. If your contracts’ location is different from the country where the Advertising User is located certain fees may apply, including for the currency exchange service, and the amount registered on your bank statements may differ from the amount shown on the Experience booking receipt. IN NO EVENT IS OXdreams RESPONSIBLE FOR ANY APPLICABLE FEES ARISING FROM INTERNATIONAL PAYMENTS. ALWAYS CONTACT YOUR BANK, CREDIT CARD COMPANY OR PAYMENT SERVICE IF YOU HAVE ANY QUESTIONS ABOUT APPLICABLE FEES OR EXCHANGE RATES.
If you make a change to an Experience booking made with a payment method, OXdreams will inform You of the new amount, as applicable. If the alteration increases the value of the Experience, a supplementary payment will be required in the amount of the increase resulting from the alteration. In the event that OXdreams is unable to collect your Payment, You will recieve a notification about the Payment being declined, with the request to complete the Payment using an alternative payment method within an indicated time frame. If You do not complete the payment, You authorize OXdreams to cancel the booking on your behalf. In the event that a booking is canceled, in accordance with the terms of the Cancellation Policy, any amounts charged will be fully refunded for the amount determined for the Experience.
OXdreams is not responsible for any losses You suffered as a result of incorrect informations about your payment method You indicated.
OXdreams reserves the right to refuse or limit payments that we believe may (i) breach the policies or procedures of the OXdreams’ Platform, (ii) may beach these Payment Terms, (iii) that are not authorized, or (iv) are considered doubtful, fraudulent or illegal.
Payment methods may involve the use of third party services providers. Accordingly, additional policies to these Payment Terms may contain additional conditions.
As applicable, OXdreams may limit the amount of a Payment by an Advertising User, due to safety reasons and compliance with local regulations.
These Terms and Payment may be changed from time to time. In the event of significant changes, we will communicate such changes to You through the available means of contact. Without prejudice, You should check this page periodically in order to review the Payment Terms
OXdreams may change the Service Fee, according to the Terms, and any applicable fees wil be disclosed in the Terms or through OXdreams' Platform. Users agree to pay in full any amounts due for using the Platform, whether as an Advertising User or a Purchasing User. In the event that OXdreams is unable to charge any amount You owe according to these Payment Terms, OXdreams’ may take all the precautionary collecting measures to recover those amounts from You.
You explicitly agree that all communications related to the dued amounts will be made by e-mail or by cell phone, depending on what you provided to OXdreams. This communication can be made by OXdreams or by anyone on its behalf including, among others, a third party collecting agent.
OXdreams WILL NOT BE LIABLE, IN ANY CASE, FOR ANY DELAY OR FAILURE TO COMPLY WITH ANY OBLIGATIONS AND CONDITIONS OF THESE PAYMENT TERMS RESULTING FROM CAUSES OUTSIDE OF OXdreams’ CONTROL, INCLUDING, AMONG OTHERS, ACTS OF NATURE, NATURAL DISASTERS, WARS, TERRORISM, RIOTS, EMBARGOS, ACTS OF CIVIL OR MILITARY AUTHORITIES, FIRES, FLOODS, ACCIDENTS, PANDEMICS, EPIDEMICS, DISEASES, STRIKES OR INTERRUPTIONS OF TRANSPORT SERVICES, FUEL, ENERGY, OR WORKPLACE.
In the event that any part of these Payment Terms is considered or found to be illegal or unachievable, that provision will be removed and the remainder of the Payment Terms will remain in full force and effect. When processing payments from a User, OXdreams can retain and/or report information related to the User and/or to the corresponding transaction to the competent authorities (when applicable), to comply with the current applicable legislation and certain regulatory and preventional procedures of money laundering activities.
